Welcome to Travel Smart. These Terms of Use apply to the Travel Smart website, mobile app, member features, content pages, push notifications, APIs, and other services that we provide or manage. By using the service, you agree to these terms. If you do not agree, please stop using the service.

1. Nature of the Service

Travel Smart provides travel articles, destination information, itinerary inspiration, member bookmarks, itinerary planning, sharing, content reports, merchant, event, promotion, and advertising information. The service is a general travel information and planning tool. It is not a travel agency, ticketing agent, insurer, visa adviser, legal adviser, medical adviser, safety adviser, or other professional adviser.

We try to keep content useful and accurate, but travel information may change because of weather, transport, immigration requirements, opening hours, prices, event arrangements, merchant policies, or other circumstances. You should verify information with official sources, operators, merchants, or relevant authorities before booking, purchasing, travelling, or making decisions.

2. Member Accounts

Some features require registration or member login. You agree to provide accurate, current, and complete information, and to keep your login credentials, devices, and access secure. Activity through your account may be treated as your responsibility unless it is shown to be outside your authorization or reasonable control.

We may suspend, limit, or terminate your account or features if we reasonably believe your account has been compromised, has breached these terms, has been used for improper activity, or if action is needed to protect other users, partners, or the service.

3. Acceptable Use

You must not use the service for unlawful, fraudulent, harassing, defamatory, privacy-invasive, infringing, malicious, spam, unauthorized scraping, reverse engineering, system interference, security testing, restriction-bypassing, or harmful activity.

You must not submit content that is false, misleading, improper, infringing, hateful, abusive, pornographic, violent, unsafe, or that includes another person's personal data without authorization.

4. Member Content and Submissions

You may create itineraries, share itineraries, submit content reports, suggest locations, bookmark content, set preferences, or provide other information. You retain rights you already own, but grant Travel Smart a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, copy, process, publish, display, store, back up, moderate, adapt, translate, improve, promote, and provide your submitted content for operating the service.

You confirm that you have the right to submit the content and that it does not infringe third-party rights or applicable law. We may refuse, edit, hide, remove, archive, or restrict member content at our discretion, but we are not required to pre-screen all content.

5. Intellectual Property

Except for member content and third-party content, the service design, text, images, trademarks, logos, databases, code, features, and other materials are owned by or licensed to Travel Smart. Unless we agree otherwise in writing, you may use this material only for personal, non-commercial, normal browsing and use of the service.

You must not copy, distribute, adapt, sell, rent, publicly display, create derivative works from, bulk download, build a database from, scrape, or otherwise exploit service content without authorization.

6. Merchants, Events, Promotions, Ads, and External Links

The service may display merchants, events, promotions, advertisements, sponsored content, external websites, or third-party services. Unless expressly stated, Travel Smart is not the provider or guarantor of third-party products, services, bookings, transactions, terms, prices, availability, refunds, cancellations, safety, quality, or performance.

Your communications, transactions, bookings, payments, event participation, or use of external websites are between you and the relevant third party and are governed by that third party's terms and privacy policy.

7. Changes and Availability

We may add, modify, suspend, or discontinue any part of the service, including content, features, APIs, member permissions, regional support, notifications, and commercial arrangements. The service may be interrupted or contain errors due to maintenance, updates, networks, third-party services, force majeure, or other reasons.

8. Privacy

Please read our Privacy Policy for how we collect, use, retain, disclose, and protect personal data. By using the service, you acknowledge that you have read that policy.

9. Disclaimers and Liability Limits

To the fullest extent permitted by applicable law, the service and content are provided on an "as is" and "as available" basis without express or implied warranties. We do not guarantee that the service will be uninterrupted, error-free, secure, meet your expectations, or that all information is accurate, complete, current, or suitable for any particular purpose.

To the fullest extent permitted by applicable law, Travel Smart will not be liable for your use of or inability to use the service, reliance on information, third-party interactions, travel arrangements, delays, losses, injuries, data loss, business loss, or any indirect, incidental, special, punitive, or consequential damages.

10. Termination

You may stop using the service at any time. If you breach these terms, or if we reasonably believe action is needed to protect the service, other users, merchants, partners, third parties, or legal compliance, we may suspend or terminate your access.

11. Updates

We may update these terms from time to time. The updated version will be posted on this page and will be effective according to the date shown above. For material changes, we may notify you through the website, app, email, or other reasonable means. Continued use after an update means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Unless applicable law requires otherwise, disputes relating to these terms or the service are subject to the non-exclusive jurisdiction of the Hong Kong courts.
